1. Definitions

• "IchiZen Labs," "we," "us," or "our" refers to IchiZen Labs, operated by Binuri Beneragama, located in Tbilisi, Georgia.
• "Products" refers to all goods and services offered, including the IchiZen EEG Kit (hardware), Mind Explorer software, and educational courses.
• "Customer," "you," or "your" refers to any individual or entity purchasing or using our products.
• "Website" refers to the IchiZen Labs website and shop.

2. Products & Services

2.1 IchiZen EEG Kit (Hardware)

The IchiZen EEG Kit is a consumer-grade electroencephalography device designed for personal brain exploration, experimentation, and educational purposes. It is NOT a medical device and should not be used for medical diagnosis, treatment, or clinical purposes.

2.2 Mind Explorer Software

Mind Explorer is EEG analysis software provided as a digital download. The software is licensed, not sold, to you for personal, non-commercial use unless otherwise agreed in writing.

2.3 Educational Courses

Our courses provide educational content about EEG, neuroscience, and related topics. Course content is for informational and educational purposes only.

3. Orders & Payment

• All prices are displayed in US Dollars (USD) unless otherwise stated.
• Payment must be received in full before products are shipped or digital access is granted.
• We reserve the right to modify prices at any time without prior notice.
• Orders are subject to acceptance and availability.
• You are responsible for any applicable taxes, duties, or customs fees in your jurisdiction.

4. Refund Policy

4.1 Digital Products (Software & Courses) — Non-Refundable

All purchases of digital products, including Mind Explorer software and educational courses, are final and non-refundable. Due to the nature of digital goods, once access is granted or a download link is provided, the transaction is complete and cannot be reversed.

We encourage you to review all product information, features, and system requirements carefully before purchasing.

4.2 Hardware (IchiZen EEG Kit) — Limited Refund

For hardware purchases, we offer refunds or replacements under the following conditions:

• Defective Products: If your EEG Kit arrives with manufacturing defects, we will provide a full refund or replacement at no additional cost.
• Damage During Shipping: If your product is damaged during transit, please contact us within 7 days of delivery with photographic evidence. We will arrange a replacement or refund.
• Dead on Arrival (DOA): If your device does not function upon first use, contact us within 14 days for a replacement or refund.

To request a hardware refund or replacement, email us at ichizen.labs@gmail.com with your order number and description of the issue.

4.3 Exclusions

Refunds will NOT be provided for:

• Change of mind or buyer's remorse
• Incompatibility with your system (please check requirements before purchase)
• Damage caused by misuse, negligence, or unauthorized modifications
• Products purchased from unauthorized third-party sellers
• Requests made after the specified time periods

5. Shipping & Delivery

5.1 Digital Products

Software and course access will be delivered electronically via download link or account access within 24 hours of payment confirmation.

5.2 Hardware

• Shipping times vary by location. Estimated delivery times will be provided at checkout.
• We ship internationally. Customer is responsible for any import duties, taxes, or customs fees.
• Risk of loss passes to you upon delivery to the carrier.
• We are not responsible for delays caused by customs, weather, or carrier issues.

6. License & Intellectual Property

6.1 Software License

Purchase of Mind Explorer grants you a non-exclusive, non-transferable, limited license to use the software on devices you own for personal, non-commercial purposes. You may NOT:

• Copy, modify, or distribute the software
• Reverse engineer, decompile, or disassemble the software
• Sell, rent, lease, or sublicense the software
• Remove or alter any proprietary notices or labels
• Use the software for commercial purposes without written permission

6.2 Course Content

Course materials are protected by copyright. You may view and use course content for personal learning only. Sharing, reproducing, or distributing course materials is prohibited.

6.3 Trademarks

"IchiZen Labs," "Mind Explorer," and associated logos are trademarks of IchiZen Labs. Use of these marks without permission is prohibited.

7. Disclaimers & Limitations

7.1 Disclaimer of Warranties

Products are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2 Limitation of Liability

To the maximum extent permitted by law, IchiZen Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses arising from:

• Your use or inability to use our products
• Any errors or omissions in product functionality
• Unauthorized access to your data or transmissions
• Any third-party content or conduct

Our total liability shall not exceed the amount you paid for the product in question.

7.3 Assumption of Risk

You acknowledge that EEG devices involve placing sensors on your head and recording brain signals. You assume all risks associated with the use of our products and agree to use them responsibly and in accordance with provided instructions.

8. User Responsibilities

By using our products, you agree to:

• Provide accurate information when making purchases
• Use products only for lawful purposes
• Not use products in any way that could harm yourself or others
• Follow all product instructions and safety guidelines
• Not attempt to circumvent any security measures or licensing restrictions

9. Termination

We reserve the right to terminate or suspend your access to our products or services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of Georgia (the country). Any disputes arising from these Terms or your use of our products shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the courts of Tbilisi, Georgia.

11. Changes to Terms
